Camp John Hay Development Corporation (“CJHDevCo”) hereby cautions the public against misrepresentations made by the Bases Conversion and Development Authority (BCDA) and its subsidiary, John Hay Management Corporation’s (JHMC’s), that the Court of Appeals (CA) has recognized that CJHDevCo allegedly breached their lease agreement or the Restructuring Memorandum of Agreement (RMOA). This claim is FALSE.

On the contrary, the CA upheld the RTC-Baguio City’s directive that CJHDevCo and BCDAmust submit all their disputes to arbitration. The CA precisely declined to rule on the issues now pending in arbitration, with the CA stating:

“FINALLY, THE RECORDS OF THE CASE REVEAL THAT THE FACTUAL ALLEGATIONS OF THE PARTIES ALREADY REFER TO THE MERITS OF THE CONTROVERSY BETWEEN THEM, WHICH IS THE ALLEGED BREACH OF THEIR RMOA [RESTRUCTURING MEMORANDUM OF AGREEMENT]. THESE ISSUES ARE BEST THRESHED OUT IN THE APPROPRIATE ARBITRATION PROCEEDINGS.”

“IT BEARS EMPHASIS THAT THE PARTIES IN THIS CASE HAVE BEEN DIRECTED TO SUBMIT THEIR CONTROVERSY TO ARBITRATION, WITH DUE STRESS ON THE POLICY OF THE SUPREME COURT TO ENCOURAGE ARBITRATION AS AN ALTERNATIVE METHOD OF DISPUTE RESOLUTION…”

This will explain why, despite the CA Decision, the BCDA’s Atty. Peter Paul Andrew Flores, made the following statement to the media: “For practicalreasons, (the BCDA) will not take over now because the decision from the arbitration committee is set to be out soon.”
Thus, any notices by BCDA urging you to directly transact with BCDA relating to your investment in the Camp is clearly WITHOUT LEGAL BASIS. If you have received such communications from BCDA please immediately report and forward them to CJHDevCo at the contact details given below for your legal protection:
